Legislation in the Europe Union and in Slovenia
Basic Council Directive 91/414/EEC concerning the placing of Plant Protection Products (PPP) has introduced a more centralised evaluation and registration process of active substance (AS). According to its assessment the AS is included in Annex I to the Directive or not.
AS is approved if the extensive list of documents and studies is completed (in the light of current scientific and technical knowledge) in a satisfactory manner and in accordance with the requirements and principles of the EU body (physical – chemical properties; analytical method; toxicological studies and studies of metabolism; efficiency; residues; fate and behaviour in the environment; ecotoxicological studies; Classification, Labelling and Packaging – CLP of chemical substances and mixtures of the Globally Harmonised System – GHS).
The Classification, Labelling and Packaging (CLP) Regulation is strongly linked to REACH (Registration, Evaluation, Authorisation and restriction of Chemicals). Information produced within the framework of the REACH provisions must be used for the Classification of the chemicals. Under the substance evaluation process of REACH the European Chemical Agency (ECHA) is responsible for the implementation.
Copper Oxychloride (COC) is evaluated as a positive AS, which means that all of PPP (which includes COC) in the European Union territory can be successfully registered.
A very complex European legislation (including the new Regulation No. 1107/2009) is legally binding and directly applicable on all of its Member States.
Registration and authorization of plant protection products and implementation of Regulation No. 1107/2009 in Slovenia is regulated by the Plant Protection Products Act (ZFfS-1) with all its implementing regulations.
Use of active substance copper oxychloride
AS is used for PPP in its original form (in which it is delivered to user). Its purpose is to protect plants against harmful organisms or to prevent the activity of such organisms in the open-air, and for the purpose of use in production under protection (greenhouses).
